    The Staff Health and Welfare Service (SH&WS) and more specifically its Staff Welfare Section (SWS), are entrusted with addressing these challenges. The Staff Welfare team comprises the Staff Welfare Officers based in Geneva, Dakar, Kinshasa, Nairobi, Juba, Bangkok, Amman and Beirut. The team works together in designing staff welfare programmes under the leadership of the Chief, SWS.The SW function in Nairobi covers the UNHCR operations in East and Horn of Africa, the Great Lakes region (with the exception of DRC) and the Southern Africa Region and it is responsible for: Implementation of the existing global staff welfare projects including psychological preparation, end of assignment debriefings, critical incident response, training and coordination of the Peer Support Personnel Network and the implementation of the framework for staff support in high-risk environments.Provision of technical expertise related to programmes of psychological well-being of staff and their family members for each duty station within the operation (assessment of psychosocial needs, programme design, programme implementation and management, evaluation, training design and delivery).Provision of clinical work with colleagues and their family members (psychological assessment, individual/group counselling, crises interventions, referrals) when needed.
    Provision of expert advice and guidance to the Representatives of the operations covered by the function, the Snr. Staff Welfare Officer in RSC Nairobi and the Chief of the Staff Welfare Section/ Staff Health and Welfare Service (SH&WS) at the HQ.The position of the SWO is responsible for the francophone operations in the region as well as for the operations in the Southern Africa sub-region.
    ESSENTIAL MINIMUM QUALIFICATIONS AND PROFESSIONAL EXPERIENCE REQUIRED

    Undergraduate degree (equivalent of a BA/BS) in in Clinical Psychology, Psychotherapy, Counselling or other mental health care profession plus minimum 6 years of previous job experience relevant to the function of which 2 years should be in an International capacity. Graduate degree (equivalent of a Masters) plus 5 years or Doctorate degree (equivalent of a PhD) plus 4 years of previous relevant work experience may also be accepted.
    Demonstrated clinical experience and counselling skills.

    ORGANIZATIONAL CONTEXT
    The Senior Investigation Specialist is a newly created out-posted position located in the IGO’s Oversight Unit in Nairobi, Kenya. This Unit will initially be composed of 4 professional positions and 1 General Service position. The incumbent will report to the Head of the IGO Unit in Nairobi.The ultimate aim of the IGO is to support the effective, efficient and accountable management of UNHCR operations and to play a positive role in upholding an environment of integrity in UNHCR by contributing to the maintenance of the highest standards of personal and professional conduct by UNHCR personnel, and all entities with contractual links to UNHCR.
    The Investigation Service, working under the authority of the Inspector General, has responsibility for carrying out investigations into possible misconduct within UNHCR in a timely and appropriate manner and that findings are transmitted to the Inspector General.The Senior Investigation Specialist reports to the Head of the IGO Unit and works independently or as part of a team on investigation cases assigned to him or her by the Head of Unit. The Senior Investigation Specialist has extensive contacts with all levels of staff within UNHCR, as well as with staff from other organisations, governments, NGOs and with UNHCR beneficiaries.An important aspect of the position is to expand the IGO’s investigation capacity, efficiency and strategic reach. The post will serve to enhance the IGO’s focus and response to investigations, notably in the African region.
    In addition to conducting investigations, the Senior Investigation Specialist will support the IGO’s strategic objectives to strengthen the investigation capacity of partner agencies in the region, as well as coordinate and deliver advanced training on investigations as may be required.The Senior Investigation Specialist investigates cases of alleged misconduct by establishing facts based on evidence gathered from available sources. The incumbent of the post must be able to operate independently and to the highest standards of impartiality and integrity as investigation cases may lead to the imposition of disciplinary measures by DHRM on individual staff members.
    ESSENTIAL MINIMUM QUALIFICATIONS AND PROFESSIONAL EXPERIENCE REQUIRED

    Graduate degree (equivalent of a Master¿s) in Law, Criminology, Criminal Justice, Public Administration or related subject bearing on the conduct of investigations in administrative and/or criminal law contexts plus minimum 8 years of progressively responsible experience in the field of investigations, including proven experience in the field of forensic audit and/or fraud examination. Of these 8 years, at least 7 years in an international environment within the UN Common System or other international organizations. Undergraduate degree (equivalent of a BA/BS) plus 9 years or Doctorate degree (equivalent of a PhD) plus 7 years of previous relevant work experience may also be accepted.
    Formal professional qualifications and/or certifications involving study, training and examinations in investigatory work.

    The primary functions of project control are to complement programme management and provide oversight of projects including the formulation of performance monitoring plans for PPAs and direct implementation, quality assurance, and verification, and ensuring compliance with UNHCR programme and financial rules, policies and procedures.     Kenya has an estimated 18,500 stateless persons, descendants of migrants who generally arrived in Kenya during the colonial era. Upon independence they did not acquire Kenyan citizenship, and were not recognized as nationals of the countries of their forefathers, leaving them stateless. Many others may be at risk of statelessness through biased application of legal identity documentation procedures such as vetting conducted among certain ethnic groups during the birth registration procedure.
    Kenya’s legislation protects persons with an undetermined nationality and or at risk of statelessness. The Constitution of Kenya, 2010, contains a progressive Bill of Rights and a revised chapter on citizenship. The Kenya Citizenship and Immigration Act 2011 defines stateless persons and sets out the requirements for the registration of such persons and their descendants as citizens of Kenya. Similar provisions apply to some categories of migrants who do not possess identification documents. However, the operational definition in the aforementioned Act limits eligibility for registration to persons who were in the country by 1963. There is need to broaden the legislation to include persons who entered the country after 1963 and their descendants. Furthermore, Kenya has not acceded to the Conventions on statelessness. Stateless persons continue to face challenges such as arbitrary arrests and exposure to all forms of discrimination in their daily lives. During participatory assessments conducted in 2016, persons of concern explicitly stated that they could not access birth certificates due to discrimination. Formal employment opportunities, access to financial services and freedom of movement were out of reach owing to lack of identity cards.
    The Assistant Protection Officer (Statelessness) will work in the Protection Unit and will report to Senior Protection Officer.
    The incumbent will have the primary responsibility for the development of legal and operational strategies to resolve and prevent statelessness situations in Kenya. The incumbent will also provide technical and operational advice and support to partners and other relevant stakeholders on statelessness issues. Support activities will include capacity building of the UNHCR and relevant partner staff in Kenya on statelessness, analysis and technical advice on nationality legislation and its implementation, coordination and harmonization of national interventions.
    S/he will also provide functional guidance to programme staff. The incumbent assists in monitoring performance of implementing partners. S/he interacts on a very regulate basis with the IP staff and provides overall guidance as per the planes activities and budget.
    The Assistant Protection Officer (Statelessness) is expected to coordinate the planning and delivery of all statelessness activities for the Operation. S/he contributes to designing a comprehensive statelessness strategy and represents the organization externally on statelessness issues and policy, as guided by the supervisor.
    S/he also ensures that stateless persons are consulted and involved with the Office in making decisions that affect them, whether in accessing their rights or in identifying appropriate solutions to their problems. To achieve this, the incumbent will need to build and maintain effective interfaces with communities of concern, local authorities and all relevant stakeholders.

    Purpose and Scope of Assignment
    Refugees in Kenya are primarily identified for resettlement due to protection needs in line with the resettlement criteria in the Resettlement Handbook. In Kakuma, refugees are identified for resettlement through a new tool known as the Application for Integrated Management (AIM) for Protection and Durable Solutions. The United States receives the largest percentage of resettlement submissions; over 90%. Canada and Australia also receive cases from the Kenya operation. In 2018, selection missions from various countries are planned. The consultant will work under the direct supervision of the Solutions (Resettlement) Officer at the UNHCR Sub-Office Kakuma.
    Duties and Responsibilities

    Under the supervision of the Resettlement Officer, the incumbents will perform the following duties:
    Interview refugees, undertake necessary action / assessments to finalise the resettlement assessment, including, refugee status determinations and complete RRFs for cases deemed by the office to meet the resettlement criteria;
    Complete Resettlement Referral Forms (RRFs) to meet agreed targets in Kakuma. The consultant is expected to complete 6 RRFs per week or a NFF in lieu of an RRF when and if the case interviewed is recommended for closure;
    Liaise with other functional units with UNHCR and partner agencies to ensure necessary action is taken / assessments made to finalise documentation on resettlement submissions;

    Living Conditions
    Kakuma is a security level 3 duty station, but it is relatively safe with very little criminality.
    Staff members live in accommodation provided within the Office compound. The climate for most of the year is characterized by dry and hot temperatures.
    There are limited medical facilities in Kakuma that are not fully equipped to deal with serious medical cases. Evacuation opportunities are limited. However, air ambulance evacuation can be organized for life threatening emergencies during day time. Candidates with conditions requiring regular treatment or medical supervision should be appropriately advised.
    There are good banking facilities in Lokichoggio and Lodwar towns which are located about 1hr and 2hrs away from Kakuma, respectively, and Equity Bank in Kakuma Town.

    The Regional Statelessness Unit at the UNHCR Regional Service Centre (RSC) based in Nairobi is seeking to strengthen its engagement with States and other actors to better identify and protect, resolve existing situations of statelessness and prevent new cases in 16 countries within the region of Central, East and Horn of Africa including Central African Republic, Cameroon, Chad, Republic of Congo, DRC, Burundi, Rwanda, South Sudan, Sudan, Kenya, Tanzania and Uganda.
    Building regional and continental synergies among African States and creating adequate State mobilization on the right to nationality are critical to ensure effective prevention, reduction and elimination of statelessness by all the countries in the region. This will also contribute to ensuring sufficient support among African Union Member States for finalizing and adopting the draft AU protocol to the African Charter on Human and People’s Rights on the right to nationality and eradication of statelessness. Conducting targeted advocacy towards a range of stakeholders will also be essential and will be increasingly pursued at regional and at national level to ensure that all actors have adequate understanding of issues relating to nationality and statelessness within the region, enabling them to take appropriate actions to end statelessness.
    Against this backdrop, the Regional Statelessness Unit at UNHCR RSC is looking to enhance regional dialogue in a coordinated, inclusive and sustained manner to prevent, reduce and eliminate statelessness in the region. UNHCR is partnering with key regional organizations such as the International Conference of the Great Lakes Region (ICGLR), and is also looking to cooperate with other relevant organizations in the region (i.e. IGAD and EAC).
    The ICGLR has already spearheaded efforts to address statelessness by ensuring access to nationality and proof of legal identity across the region. The 12 ICGLR Member States adopted in October 2017 the Brazzaville Declaration and Regional Action Plan on eradication of statelessness, which sets out key commitments in line with UNHCR’s Global “IBelong” Campaign to end statelessness. This is a significant achievement, with States committing to adopt National Action Plans; reform their legislation and policies on nationality and civil status; improve birth registration systems, and conduct national and regional studies on the issue by 2019.
    UNHCR’s technical support in implementing this Declaration’s commitments requires sustained efforts with dedicated staff, in order to move ahead with a series of activities at national and regional level in 2018 and beyond. These allow for a progressive approach; training and sensitising Government Focal Points nominated as per the Brazzaville Declaration, as well as ICGLR National Coordinators; promoting ratification of the international conventions on statelessness; and culminating in a Ministerial Meeting foreseen for late 2018 with the aim of extending this Regional Action Plan to 2024 and triggering the development of an ICGLR Protocol on eradication of statelessness under the ICGLR Pact. Achieving the objectives of the Brazzaville Declaration are crucial in furthering progress ahead of the 2019 High Level Event on Statelessness, including as part of the build up to the adoption of the draft AU Protocol.
    Functional responsibilities & Tasks
    Under the direct supervision of the Snr. Regional Protection Officer (Statelessness), the incumbent will:

    Assist the Regional Statelessness Unit in supporting the ICGLR Executive Secretariat and Member States to implement the commitments contained in the Brazzaville Declaration and Regional Action Plan, including:
    Supporting the preparation of the training workshops for ICGLR National Coordinators and government focal points on statelessness;
    Assisting in the preparatory work ahead of the Ministerial Meeting foreseen in late 2018 on statelessness in the ICGLR region;
    Assist in monitoring implementation progress of the Regional Action Plan;
    Provide inputs and support to the UNHCR country operations developing and operationalizing strategies to eradicate statelessness, including review of nationality related legislation;
    Assist in the cataloguing of the Unit’s documents, including by developing a resource library for statelessness in the Great Lakes, Horn of Africa and East African region;
    Assist in producing communications tools such as web stories and articles, brochures, one-pagers, and visibility items to support the office’s advocacy work and ensure coverage of the ICGLR process and efforts to eradicate statelessness at country and regional levels;
    Assist in collecting inputs from country operations in order to prepare quarterly newsletters, including pictures, movies and stories;
    Assist in updating the Regional Data Portal on statelessness;
    Pro-actively provide administrative and logistical support for all activities organized by the section, such as conferences, workshops and trainings;
    Assist in generating regular reports on progress, successes, challenges, constraints and lessons learned in the area of statelessness;
    Provide support for any other operational tasks when required.

    Qualifications (academic and work experience)

    Advanced university degree (Masters or equivalent) in law preferably with focus on human rights, refugee law and/or international humanitarian law;
    Excellent legal research and analytical skills;

    Status of the intern and insurance

    Interns are neither “staff members” under the Staff Regulations and Rules of the United Nations, nor “officials” within the meaning of the Convention on the Privileges and Immunities of the United Nations of 13 February 1946, as interns are not remunerated for their work. As of 1 June 2018, interns that do not receive financial support from an outside party will receive a monthly Food and Local Transportation Allowance equivalent to 10% of the Daily Subsistence Allowance for Nairobi duty station and based on 30 calendar days (not exceeding USD 1,000 per month).
    Interns may not represent UNHCR in any official capacity.
    Costs and arrangements for travel, visas, accommodation and living expenses are the responsibility of the intern or his/her sponsoring institution. However, UNHCR will help with the visa application if applicable and advise accordingly.
    Interns are not subject to UN security evacuation procedures but may be assisted to leave the country when possible and to the extent feasible.
    Interns are fully responsible for arranging medical insurance covering their full internship period. Interns will be requested to show proof of valid medical (and life/accident) insurance for the duty station. It must include adequate coverage in the event of an injury or illness during the internship. UNHCR accepts no responsibility for the medical and life insurance of the intern or costs arising from accidents and illness incurred during an internship. As interns are not covered under any insurance, they should not travel to hazardous locations in the course of their internship with UNHCR.
    Interns will not engage in any activity that is incompatible with the aims and objectives of UNHCR.
    Interns will maintain confidentiality of all unpublished information made known to them during the internship and will not publish any reports on the basis of information obtained during the period without prior written permission of UNHCR.
